1. Acceptance of Terms

By downloading, installing, accessing, and using the HoopLab mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. We reserve the right to modify these Terms at any time. Continued use of the App after modifications constitutes acceptance of the updated Terms.

2. Service Description

HoopLab is a basketball-focused strength and conditioning training application that provides:

• Personalized workout plans designed for basketball players
• Exercise demonstrations and technique guidance
• Training progress tracking and analytics
• Basketball-specific conditioning programs
• Workout logging and performance metrics
• Real-time fitness recommendations
• Premium features available through subscription

3. Subscription and Pricing

3.1 Free Tier

HoopLab offers a limited free tier that includes:

• Basic workout logging
• Access to selected training programs
• Limited progress tracking
• Community features (if available)

3.2 Premium Subscription Plans

HoopLab offers premium subscription plans with different pricing based on your location and billing cycle:

3.3 Free Trial

New users receive a complimentary 7-day free trial to access all premium features at no cost. The trial begins when you first access the App. You must provide valid payment information to start the trial, but you will not be charged during the trial period.

At the end of the 7-day trial period:

• Your account will automatically convert to the free tier if you do not subscribe
• If you choose to subscribe, billing will commence on day 8
• You can cancel the trial anytime before it ends with no charges

3.4 Automatic Renewal and Billing

• Subscriptions automatically renew at the end of each billing period unless cancelled
• You will be charged on the renewal date through the payment method you provided
• Charges appear on your monthly or annual renewal date (depending on your plan)
• You agree to be charged for renewals automatically

3.5 Price Changes

We may change subscription prices from time to time. If you have an active subscription, price changes will take effect on your next renewal date. We will notify you of significant price increases at least 30 days in advance.

3.6 Cancellation and Refunds

Cancellation:

• You can cancel your subscription anytime through your account settings or by contacting us at 2313383422@qq.com
• Cancellation takes effect at the end of your current billing period
• You retain access to premium features until your billing period ends
• If you cancel during the free trial, no charges will apply

Refund Policy:

• Subscriptions are generally non-refundable
• For cancellations within 7 days of initial subscription purchase, refunds may be available upon request
• All refund requests must be submitted directly to Apple. HoopLab does not process refunds independently. To request a refund, visit https://reportaproblem.apple.com
• Refunds are processed by Apple according to their refund policy and are subject to app store regulations

3.7 Payment Processing

All payments are processed by Apple through In-App Purchase (IAP). Payment information is handled solely by Apple and is subject to Apple's Privacy Policy at https://www.apple.com/legal/privacy/

Your payment information is not directly handled by HoopLab but is processed according to Apple's payment policies and security standards. HoopLab does not store or access your payment details.

4. User Account Responsibilities

4.1 Age Eligibility

You must be at least 13 years old to use HoopLab. By using the App, you represent and warrant that you meet this age requirement. Accounts of users under 13 will be terminated immediately.

4.2 Account Creation and Security

You are responsible for:

• Providing accurate, complete, and current account information
• Maintaining the confidentiality of your login credentials and password
• Keeping your email address and contact information up to date
• Notifying us immediately of any unauthorized access to your account
• All activities that occur under your account

4.3 Acceptable Use Policy

You agree not to use the App for:

• Any illegal, unethical, or harmful activity
• Sharing, selling, or transferring your account to another person
• Reverse-engineering, hacking, or exploiting the App or its systems
• Posting abusive, threatening, defamatory, or harmful content
• Interfering with the App's functionality, servers, or network
• Collecting or scraping user data without authorization
• Using automated tools, bots, or scripts to access the App
• Circumventing security features or access controls
• Impersonating another person or entity

4.4 Health and Safety Disclaimer

IMPORTANT - PLEASE READ CAREFULLY:

HoopLab provides general fitness guidance and training recommendations. The App is NOT a substitute for professional medical advice, diagnosis, or treatment.

• Before starting any fitness program, especially if you have pre-existing health conditions, injuries, or physical limitations, consult with a qualified healthcare provider or sports medicine physician
• You assume full responsibility for any injuries, health consequences, or damage resulting from your use of the App or the exercises you perform
• Stop exercising immediately if you experience pain, dizziness, shortness of breath, chest pain, or any other concerning symptoms
• Use proper form and technique to minimize injury risk. If unsure about an exercise, consult a certified fitness professional
• Use appropriate equipment and ensure your training environment is safe
• Listen to your body and respect your physical limits. Progress gradually
• We are not responsible for any injuries or health issues arising from your use of HoopLab

5. Intellectual Property Rights

All content in HoopLab, including but not limited to workout programs, exercise descriptions, animations, instructional videos, designs, logos, text, code, and graphics, is the intellectual property of Yongjiang Guo or licensed to HoopLab.

You may not:

• Reproduce, modify, distribute, or publicly display any content without written permission
• Create derivative works based on HoopLab's content
• Use HoopLab's content for commercial purposes
• Remove or alter any copyright, trademark, or proprietary notices

You retain ownership of any content you create in the App (such as notes or personal records), and you grant HoopLab a license to store and use this content to provide the service.

6. Limitation of Liability

6.1 "As-Is" Provision

TO THE FULLEST EXTENT PERMITTED BY LAW, HOOPFIT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OR GUARANTEES. We disclaim all warranties, express or implied, including but not limited to:

• Warranty of merchantability
• Warranty of fitness for a particular purpose
• Warranty of non-infringement
• Warranty of accuracy, completeness, or timeliness
• Warranty of uninterrupted or error-free operation

6.2 Exclusion of Damages

To the fullest extent permitted by law, HoopLab and its developers shall not be liable for:

• Any indirect, incidental, consequential, special, or punitive damages
• Loss of data, revenue, profits, or business opportunities
• Loss of goodwill or reputation
• Injuries sustained during workouts or fitness activities
• Technical issues, service interruptions, or downtime
• Unauthorized access to or alteration of your data
• Third-party conduct or content

6.3 Liability Cap

Our total liability for any claim arising from this Agreement shall not exceed the amount you paid for your subscription in the 12 months preceding the claim (or $10 if you have not paid for any subscription).

7. Indemnification

You agree to indemnify, defend, and hold harmless Yongjiang Guo, HoopLab, and their affiliates, employees, contractors, and partners from and against any and all claims, damages, costs, and liabilities (including legal fees) arising from or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of third-party rights
• Any content you create or share
• Injuries or health issues resulting from your fitness activities

8. Account Termination

We reserve the right to suspend or terminate your account and access to the App if:

• You violate these Terms of Service
• You engage in fraudulent, unauthorized, or abusive activity
• You fail to pay subscription fees (after 30 days written notice)
• We are required to do so by law
• We determine it is necessary for security, legal, or safety reasons

Upon termination, your access to the App will be restricted. You may request a copy of your data within 30 days of termination.

9. Data Usage and Privacy

Your use of HoopLab is governed by our separate Privacy Policy, which is incorporated into and forms part of these Terms. Please review our Privacy Policy to understand our data collection, storage, and usage practices.

10. Third-Party Services and Content

HoopLab may integrate with, reference, or link to third-party services (payment processors, analytics, cloud storage, social media platforms). Your use of these third-party services is governed by their own terms and privacy policies. We are not responsible for:

• Third-party service availability or functionality
• Third-party privacy practices or data handling
• Third-party content, links, or recommendations
• Any issues arising from your use of third-party services

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. However, this choice of law does not prevent you from asserting claims under laws that cannot be waived.

11.2 Jurisdiction

For users in the United States, you agree to submit to the exclusive jurisdiction of the courts located in Delaware, United States. For users in other jurisdictions, disputes may be resolved through local courts where permitted by law.

11.3 GDPR and EU Rights

For users in the European Union, nothing in these Terms limits your rights under the General Data Protection Regulation (GDPR). EU users also have the right to dispute resolution through alternative mechanisms available in your jurisdiction.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, it shall be severed. The remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and HoopLab regarding your use of the App and supersede all prior agreements, negotiations, and understandings, whether written or oral.
